The Charter of Fundamental Rights declares that everyone has the right to freedom of peaceful assembly and freedom of association at all levels in, particularly in political, trade union and civic matters. This implies the right of everyone to form and to join trade unions for the protection of his or her interest.\u00a0 Political parties at Union level contribute to expressing the political will of the citizens of the EU.<\/p>\n
Issues have arisen as to the extent to which the freedom to form trade unions and take industrial action is compatible with the fundamental freedoms of capital, goods, services and persons under the EU Treaties.<\/p>\n
The European Court of Justice takes a view that the freedom of association under European Union law protects the rights to collective action and the right to strike.\u00a0 However, it is not an absolute right and is subject to limitations and restrictions. There is a right to join and not to join a trade union under EU law.<\/p>\n
As under the Convention, the right to freedom may be subject to restrictions for legitimate purposes. The European Court has taken the view that neither the fundamental freedoms nor the rights to form associations etc. are absolute.\u00a0 This recognises that the union has a social as well as an economic purpose and accordingly, free movement must be reconciled with working and living conditions.<\/p>\n\n
