domiciliary care allowance payable.<\/a><\/li><\/ul><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n<h3><span class=\"ez-toc-section\" id=\"Domiciliary_Care_Allowance\"><\/span>Domiciliary Care Allowance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>A Domiciliary Care Allowance is a monthly payment to assist with the cost of a severely disabled child who requires full-time care and attention. The requirements must be such as are substantially beyond the requirements of a non-disabled child of the same age. The benefit is at \u20ac309.50 per month.<\/p>\n<p>The allowance is paid to a qualified person. It is paid in respect of a quantified child. A qualified child is a child who is under 16 and has a severe disability which requires continuous care and attention substantially in excess of that normally required for a child of the same age. The disability must be such that the child is likely to continue to require such care and attention for at least 12 months.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Claim_and_Eligibility\"><\/span>Claim and Eligibility<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The claim is assessed by medical assessors of the Department.\u00a0 The child must reside with the qualified person, and that person must provide for the child&#8217;s care. The person concerned must be habitually resident in the State.<\/p>\n<p>The payment \u00a0is not subject to a means test or contribution requirements. The child must ordinarily reside in the State. The allowance is also available to certain \u00a0members of the Defence Forces and Civil Service posted overseas or within international organisation and certain volunteered workers.<\/p>\n<p>The child must not be detained in a place of detention or detention school. It is not payable while the child is resident in an institution. This is a hospital, home, home for children suffering from disabilities and any other similar establishment, where the cost of the child&#8217;s maintenance is paid in whole or in part by the HSE or Department of Education.<\/p>\n<p>A reduced allowance may be payable in respect of a child temporarily resident with the qualified person for at least two days in any week.<\/p>\n<p>The allowance continues to be paid for a child admitted to an institution on a full-time basis for the purpose of receiving medical treatment of a temporary nature of not more than 13 weeks, within a yearly period.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Mobility_Allowance\"><\/span>Mobility Allowance<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Mobility Allowance support is a means tested payment, paid \u00a0to persons unable to walk or use public transport. It was formerly operated by the Health Service Executive and Health Board.<\/p>\n<p>A person between 16 and 66 years may qualify. A person who qualifies before that age may contribute to qualify. The person must normally live at home. Up to eight weeks duration in a hospital and equivalent institution is allowed while remaining qualified.<\/p>\n<p>There are a number of mobility criteria.<\/p>\n<ul>\n<li>if the applicant is unable to walk, even with artificial limbs or other aids;<\/li>\n<li>if the health condition of the applicant is such that walking is dangerous;<\/li>\n<li>if in the either of the above cases, if the incapacity is permanent or at least a year<\/li>\n<li>there are medical reasons that impair mobility<\/li>\n<li>whether they would applicant benefit from change in surrounding.<\/li>\n<\/ul>\n<p>The higher rate is \u20ac108.50 per month. A lower rate of \u20ac104.25 is payable to persons who use the disabled drivers and disabled passengers tax relief scheme. Persons who receive a motorised transport grant from the HSE cease to qualify for the Mobility Allowance.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Blind_Pension_Increases\"><\/span>Blind Pension Increases<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Blind Pension increases are payable in respect of a claimant living with or maintaining a spouse or civil partner whose spouse is not in receipt of a payment. Increments are payable to persons who live alone. Household benefits are generally available.<\/p>\n<p>A person is disqualified, where he is receiving a contributory pension. He is disqualified when in imprisonment or legal detention. Habitual residence requirements apply. The payment is not generally payable when a person resides outside the State.<\/p>\n<p><!--nextpage--><\/p>\n<h2>SWCA 2005<\/h2>\n<p>&nbsp;<\/p>\n<p>Chapter 8A<\/p>\n<h4>Domiciliary Care Allowance (ss. 186B-186H)<\/h4>\n<p>186B.<\/p>\n<h4>Interpretation.<\/h4>\n<p>In this Chapter &#8211;<\/p>\n<p>&#8220;institution&#8221;, means a hospital, convalescent home or home for children suffering from physical or mental disability or ancillary accommodation and any other similar establishment providing residence, maintenance or care where the cost of the child\u2019s maintenance in that institution is being met in whole or in part by or on behalf of the Executive or the Department of Education and Science;<\/p>\n<p>&#8220;international organisation&#8221; means an international intergovernmental organisation, including, in particular and without limiting the generality of the foregoing &#8211;<br \/>\n(a)the United Nations Organization and its specialist agencies,<br \/>\n(b)the institutions and agencies of the European Communities,<br \/>\n(c)the Council of Europe, and<br \/>\n(d)the Organisation for Economic Co-operation and Development;<\/p>\n<p>&#8220;qualified child&#8221; has the meaning given by section 186C;<\/p>\n<p>&#8220;qualified person&#8221; has the meaning given by section 186D.<\/p>\n<p>&nbsp;<\/p>\n<p>186C.<\/p>\n<h4>Qualified child.<\/h4>\n<p>(1)A person who has not attained the age of 16 years (in this section referred to as the &#8216;child&#8217;) is a qualified child for the purposes of the payment of domiciliary care allowance where &#8211;<\/p>\n<p>(a)the child has a severe disability requiring continual or continuous care and attention substantially in excess of the care and attention normally required by a child of the same age,<\/p>\n<p>(b)the level of disability caused by that severe disability is such that the child is likely to require full-time care and attention for at least 12 consecutive months,<\/p>\n<p>(c)the child &#8211;<\/p>\n<p>(i)is ordinarily resident in the State, or<\/p>\n<p>(ii)satisfies the requirements of section 219(2),<\/p>\n<p>and<\/p>\n<p>(d)the child is not detained in a children detention school.<\/p>\n<p>(2)[deleted]<\/p>\n<p>(3)[deleted]<\/p>\n<p>186D.<\/p>\n<h4>Qualified person.<\/h4>\n<p>(1)A person is a qualified person for the purpose of receiving domiciliary care allowance in respect of a qualified child if &#8211;<\/p>\n<p>(a)the child normally resides with that person,<\/p>\n<p>(b)that person provides for the care of the child, and<\/p>\n<p>(c)the person &#8211;<\/p>\n<p>(i)is habitually resident in the State, or<\/p>\n<p>(ii)at the date of the making of the application for domiciliary care allowance, is a person to whom paragraph (a), (b) or (c) of section 219(2) applies.<\/p>\n<p>(2)For the purposes of subsection (1) (a) the Minister may by regulation make rules for determining with whom a qualified child is to be regarded as normally residing.<\/p>\n<p>186E.<\/p>\n<h4>Payments while child is resident in an institution.<\/h4>\n<p>(1)Subject to subsections (2) and (3), domiciliary care allowance is not payable for any period during which a child is resident in an institution.<\/p>\n<p>(2)Subject to this Chapter, regulations may provide, subject to such conditions and in such circumstances as are prescribed, for payment of domiciliary care allowance at a rate less than the scheduled rate referred to in section 186F in respect of a qualified child in respect of whom the allowance would be payable but for the fact that the qualified child is resident in an institution, where the child is temporarily resident with the qualified person for a period of not less than two days in any one week.<\/p>\n<p>(3)Where a qualified child in respect of whom a domiciliary care allowance is payable is admitted to an institution otherwise than in the circumstances referred to in subsection (2), that allowance shall continue to be payable for such period, and in such circumstances as are prescribed.<\/p>\n<p>186F.<\/p>\n<h4>Rate of payment.<\/h4>\n<p>(1)Subject to this Act, a person shall, so long as he or she remains a qualified person, be paid out of moneys provided by the Oireachtas a monthly allowance at the rate (in this section referred to as \u2018the scheduled rate\u2019) set out in Part 5 of Schedule 4.<\/p>\n<p>(2)Regulations may provide for the payment of domiciliary care allowance at a rate lower than the scheduled rate in the case of a qualified child in respect of whom an allowance is payable in accordance with section 186E(2).<\/p>\n<p>186G.<\/p>\n<h4>Medical examination.<\/h4>\n<p>(1)A qualified child in respect of whom domiciliary care allowance is in payment shall attend for or submit to such medical or other examinations as are required in accordance with regulations.<\/p>\n<p>(2)Regulations made for the purposes of subsection (1) may also provide for disqualifying a person for receiving domiciliary care allowance where the qualified child in respect of whom the domiciliary care allowance is payable fails without good cause to attend for or submit to such medical or other examination as may be required in accordance with those regulations.<\/p>\n<p>186H.<\/p>\n<h4>Only one domiciliary care allowance payable.<\/h4>\n<p>Not more than one domiciliary care allowance is payable in any month in respect of any one qualified child.<\/p>\n<p>&nbsp;<\/p>\n<!--themify_builder_content-->\n<div id=\"themify_builder_content-19925\" data-postid=\"19925\" class=\"themify_builder_content themify_builder_content-19925 themify_builder tf_clear\">\n    <\/div>\n<!--\/themify_builder_content-->\n","protected":false},"excerpt":{"rendered":"<p>Domiciliary Care Allowance A Domiciliary Care Allowance is a monthly payment to assist with the cost of a severely disabled child who requires full-time care and attention.
