class=\"ez-toc-section\" id=\"Reformed_Law\"><\/span>Reformed Law<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>The Domestic Violence Act 2018 amends and consolidates the law in relation to domestic violence. The Act also includes new provisions that were required in order for Ireland to be able to ratify the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence, more commonly known as the Istanbul Convention. Ireland signed the Istanbul Convention in November 2015.<\/p>\n<p>The Act allows a person to apply for an emergency barring order where that person has lived in an intimate and committed relationship with the respondent without being their spouse or civil partner or where that person is the parent of an adult respondent. It also includes a provision to criminalise forced marriage.<\/p>\n<p>The Act removed the underage marriage exemption in order to help to protect minors against forced marriage, requiring both intended spouses to be at least 18.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Safety_Order\"><\/span>Safety Order<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>A safety order can be sought by:<\/p>\n<ul>\n<li>a spouse or former spouse;<\/li>\n<li>a civil partner or former civil partner;<\/li>\n<li>a person who lived with the respondent in an intimate and committed relationship;<\/li>\n<li>a parent of an adult respondent;<\/li>\n<li>a person who lives with the respondent in a primarily non-contractual relationship; or<\/li>\n<li>a person who has had a child with the respondent.<\/li>\n<\/ul>\n<p>The actions that can be prohibited through a safety order include: using or threatening the use of violence against, molesting or putting in fear, the applicant or a dependent; watching or besetting a place where the applicant or a dependant resides; and following or communicating (including electronically) with the applicant or a dependant.<\/p>\n<p>In deciding whether or not a person is residing with another person in a relationship, the basis of which is not primarily contractual, the court shall have regard to:<\/p>\n<ul>\n<li>the length of time those persons are residing together;<\/li>\n<li>the nature of any duties performed by either person for the other person or any kindred person of that other person;<\/li>\n<li>the absence of any profit or of any significant profit made by either person from any monetary or other consideration given by the other person in respect of residing at the place concerned; and<\/li>\n<li>any other matters the court considers appropriate in the circumstance.<\/li>\n<\/ul>\n<h3><span class=\"ez-toc-section\" id=\"Effect_of_a_Safety_Order\"><\/span>Effect of a Safety Order<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Where the court, on application to it, is of the opinion that there are reasonable grounds for believing that the safety or welfare of an applicant or a dependent person so requires, it shall issue a safety order, i.e. it will prohibit the respondent to the application from doing one or more of the following:<\/p>\n<ul>\n<li>using or threatening to use violence against, molesting or putting in fear, the applicant or a dependent;<\/li>\n<li>if he or she is residing at a place other than the place where the applicant or the dependent resides, watching or besetting a place where the applicant or the dependent resides; and<\/li>\n<li>following or communicating (including by electronic means) with the applicant or the dependent person.<\/li>\n<\/ul>\n<p>A safety order may be subject to such exceptions and conditions as the court may specify.<\/p>\n<p>Safety orders can remain in place for 5 years (or for a shorter period if the court so specifies). Before the expiration of that period another safety order can be made for a further period of up to 5 years.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Barring_Order\"><\/span>Barring Order<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>Barring orders can be sought by a spouse or former spouse, by a civil partner or former civil partner, by a person who lived with the respondent in an intimate and committed relationship or by a parent of an adult respondent.<\/p>\n<p>The court may make a barring order to direct a respondent to either leave a place or to prevent them from entering a place where the applicant or a dependant resides.<\/p>\n<p>The actions that can be prohibited through a barring order include: using or threatening the use of violence against, molesting or putting in fear, the applicant or a dependent; attending at, or in the vicinity of, or watching or besetting a place where the applicant or a dependant resides; and following or communicating (including electronically) with the applicant or a dependant.<\/p>\n<p>A barring order may be subject to such exceptions and conditions as specified by the court.<\/p>\n<p>In respect of a person who is a cohabitant but not a spouse, the court shall not make a barring order in respect of the place where the applicant or dependent person resides if the respondent has a legal or beneficial interest in that place and the applicant has no legal or beneficial interest, or the applicant\u2019s legal or beneficial interest is, in the opinion of the court, less than that of the respondent.<\/p>\n<p>Where in proceedings the applicant states the belief, in respect of this matter, that he or she has a legal or beneficial interest in that place which is not less than that of the respondent, then that belief shall be admissible in evidence.<\/p>\n<p>Barring orders can remain in place for 3 years (or for a shorter period if the court so specifies). Before the expiration of that period another barring order can be made for a further period of up to 3 years.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Interim_Barring_Order\"><\/span>Interim Barring Order<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>An interim barring order can be made where there are reasonable grounds to believe that there is an immediate risk of significant harm to the applicant or a dependant and the making of a protection order would not be sufficient to protect them. The court can make an interim barring order to direct a respondent to either leave a place or to prevent them from entering a place where the applicant or a dependant resides.<\/p>\n<p>The actions that can be prohibited through an interim barring order include: using or threatening violence against, molesting or putting in fear, the applicant or a dependent; attending at, or in the vicinity of, or watching or besetting a place where the applicant or a dependant resides; and following or communicating (including electronically) with the applicant or a dependant.<\/p>\n<p>An interim barring order may be made in a one-sided application (ex parte), in which case it shall have effect for a\u00a0 period not exceeding 8 working days. The applicant for an ex parte interim barring order must swear an affidavit or\u00a0 an information stating whether the property from which it is sought to bar the respondent on an interim basis is also the respondent\u2019s place of business. The interim barring order shall cease to have effect once the application for a barring order has been determined.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Emergency_Barring_Order\"><\/span>Emergency Barring Order<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>An emergency barring order may be made where there are reasonable grounds to believe that there is an immediate risk of significant harm to the applicant or a dependant. A person may apply for an emergency barring order where that person has lived in an intimate and committed relationship with the respondent without being their spouse or civil partner or where that person is the parent of an adult respondent.<\/p>\n<p>The court can make an emergency barring order to direct a respondent to either leave a place or to prevent them from entering a place where the applicant or a dependant resides. The applicant may apply for an emergency barring order even if they have no legal or beneficial interest in that place or an interest which is less than the legal and beneficial interest of the respondent.<\/p>\n<p>The actions that can be prohibited through an emergency barring order include using or threatening violence against, molesting or putting in fear, the applicant or a dependent; attending at, or in the vicinity of, or watching or besetting a place where the applicant or a dependant resides; and following or communicating (including electronically) with the applicant or a dependant.<\/p>\n<p>An emergency barring order may be made ex parte and shall have effect for a period not exceeding 8 working days. Once the period granted in the emergency barring order has expired, no further emergency barring order may be made until a period of one month has elapsed from the date of expiry of the previous order, unless the court is satisfied that there are exceptional circumstances.<\/p>\n<p>The applicant for an ex parte emergency barring order must swear an affidavit or an information stating whether the property from which it is sought to bar the respondent on an emergency basis is also the respondent\u2019s place of business.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Protection_Order\"><\/span>Protection Order<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>A protection order may be made where there are reasonable grounds to believe that the safety or welfare of the applicant or a dependant is at risk. The actions that can be prohibited through a protection order include using or threatening the use of violence against, molesting or putting in fear, the applicant or a dependent; watching or besetting a place where the applicant or a dependant resides; and following or communicating (including electronically) with the applicant or a dependant.<\/p>\n<p>The applicant for a unilateral (ex parte) protection order must swear an affidavit or an information. This material is to be served on the respondent with a copy of the order.<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Criteria\"><\/span>Criteria<span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>In deciding an application for a safety order, barring order, interim barring order, emergency barring order, protection order or in any application to vary or discharge such an order, the court will have regard to:<\/p>\n<ul>\n<li>any history of violence inflicted by the respondent on the applicant or a dependent person;<\/li>\n<li>any conviction of the respondent for an offence under the Criminal Justice (Theft and Fraud Offences) Act 2001 that involves loss to, or is to the prejudice of, the applicant or a dependent person;<\/li>\n<li>any conviction of the respondent for an offence that involves violence or the threat of violence to any person;<\/li>\n<li>whether any violence inflicted by the respondent on the applicant or a dependent person is increasing, or has increased, in severity or frequency over time;<\/li>\n<li>any exposure of a dependent person to violence inflicted by the respondent on the applicant or any other dependent person;<\/li>\n<li>any previous order under this Act or the Act of 1996 made against the respondent with regard to any person;<\/li>\n<li>any history of animal cruelty by the respondent;<\/li>\n<li>any destruction or damage caused by the respondent to the personal property of the applicant, the respondent or a dependent person, or any place where the applicant or a dependent person resides;<\/li>\n<li>any action of the respondent, not being a criminal offence, which puts the applicant or a dependent person in fear for his or her own safety or welfare;<\/li>\n<li>any recent separation between the applicant and the respondent;<\/li>\n<li>substance abuse, including abuse of alcohol, by the respondent, the applicant or a dependent person;<\/li>\n<li>access to weapons by the respondent, the applicant or a dependent person;<\/li>\n<li>the applicant\u2019s perception of the risk to his or her own safety or welfare due to the behaviour of the respondent;<\/li>\n<li>the age and state of health (including pregnancy) of the applicant or any dependent person;<\/li>\n<li>any evidence of deterioration in the physical, psychological or emotional welfare of the applicant or a dependent person which is caused directly by fear of the behaviour of the respondent;<\/li>\n<li>whether the applicant is economically dependent on the respondent;<\/li>\n<li>any other matter which appears to the court to be relevant to the safety or welfare of the applicant and any dependent person.<\/li>\n<\/ul>\n<p><!--nextpage--><\/p>\n<p>&nbsp;<\/p>\n<h2>DOMESTIC VIOLENCE ACT 2018<\/h2>\n<p>REVISED<\/p>\n<p>Updated to 1 November 2023<\/p>\n<p>&nbsp;<\/p>\n<p>An Act to consolidate the law on domestic violence; to provide for emergency barring orders in certain circumstances; to provide for evidence to be given through television link in certain proceedings; to provide for the right of an applicant to be accompanied in certain proceedings; to provide for the obtaining of the views of a child in certain proceedings; to provide for the giving of information on support services to victims of domestic violence; to provide for the making of recommendations for engagement with certain services by respondents; to provide for restrictions on those present in court during certain proceedings; to prohibit the publication or broadcast of certain matters; to provide for an offence of forced marriage; to repeal provisions for exemption, in certain cases, from minimum age requirements for marriage; for those and other purposes to repeal the Domestic Violence Act 1996 and the Domestic Violence (Amendment) Act 2002 and to provide for the consequential amendment of certain other enactments; and to provide for related matters<\/p>\n<p>[8th May, 2018]<\/p>\n<p>Be it enacted by the Oireachtas as follows:<\/p>\n<p>PART 1<\/p>\n<p>Preliminary and General<\/p>\n<h4>Short title and commencement<\/h4>\n<p>1. (1) This Act may be cited as the Domestic Violence Act 2018.<\/p>\n<p>(2) This Act shall come into operation on such day or days as the Minister may by order or orders appoint either generally or with reference to any particular purpose or provision and different days may be so appointed for different purposes or different provisions, and for the repeal of different enactments or provisions of enactments effected by section 3.<\/p>\n<p>Annotations:<\/p>\n<p>Editorial Notes:<\/p>\n<p>E1<br \/>\nPower pursuant to subs. The 1st day of January 2019 is appointed as the day on which the Domestic Violence Act 2018 (No. 6 of 2018) shall come into operation.<\/p>\n<h4>Interpretation<\/h4>\n<p>2. (1) In this Act\u2014<\/p>\n<p>\u201cAct of 1964\u201d means the Guardianship of Infants Act 1964;<\/p>\n<p>\u201cAct of 1976\u201d means the Family Home Protection Act 1976;<\/p>\n<p>\u201cAct of 1991\u201d means the Child Care Act 1991;<\/p>\n<p>\u201cAct of 1995\u201d means the Family Law Act 1995;<\/p>\n<p>\u201cAct of 1996\u201d means the Domestic Violence Act 1996;<\/p>\n<p>\u201cAct of 2004\u201d means the Civil Liability and Courts Act 2004;<\/p>\n<p>\u201cAct of 2010\u201d means the Civil Partnership and Certain Rights and Obligations of Cohabitants Act 2010;<\/p>\n<p>\u201cAct of 2013\u201d means the Courts and Civil Law (Miscellaneous Provisions) Act 2013;<\/p>\n<p>\u201cAgency\u201d means the Child and Family Agency;<\/p>\n<p>\u201capplicant\u201d has the meaning assigned to it by section 6, section 7 or section 9, as the case may be, and where\u2014<\/p>\n<p>(a) an interim barring order has been made the applicant for the barring order to whom the interim barring order relates shall be deemed to be the applicant for that interim barring order, and<\/p>\n<p>(b) a protection order has been made the applicant for the safety order or the barring order to whom the protection order relates shall be deemed to be the applicant for that protection order;<\/p>\n<p>\u201cbarring order\u201d has the meaning assigned to it by section 7(2);<\/p>\n<p>\u201cchild\u201d means a person who has not attained the age of 18 years other than a person who is or has been married;<\/p>\n<p>\u201ccivil partner\u201d has the meaning assigned to it by section 3 of the Act of 2010 and for the purposes of this Act includes a person who was a civil partner in a civil partnership that has been dissolved under the Act of 2010 but does not include a person who was in a civil partnership that has been dissolved by reason only of the application of section 109A of the Act of 2010;<\/p>\n<p>\u201ccivil proceedings under this Act\u201d means\u2014<\/p>\n<p>(a) proceedings relating to an application for the making, variation or discharge of a safety order, a barring order or an emergency barring order,<\/p>\n<p>(b) proceedings, consequent on the making of an application for a barring order, for the making, variation or discharge of an interim barring order which relates to the application,<\/p>\n<p>(c) proceedings, consequent on the making of an application for a safety order or a barring order, for the making, variation or discharge of a protection order which relates to the application,<\/p>\n<p>(d) proceedings by way of appeal or case stated which are related to proceedings to which paragraph (a), (b) or (c) applies;<\/p>\n<p>\u201ccourt\u201d means the District Court or the Circuit Court;<\/p>\n<p>\u201cdependent person\u201d, in relation to the applicant or the respondent or both of them, as the case may be, means any child\u2014<\/p>\n<p>(a) of the applicant and the respondent or in respect of whom the applicant and the respondent are in loco parentis,<\/p>\n<p>(b) of the applicant or in respect of whom the applicant is in loco parentis, or<\/p>\n<p>(c) of the respondent or in respect of whom the respondent is in loco parentis and\u2014<\/p>\n<p>(i) where the child is a child of the respondent, the applicant is in loco parentis to that child, or<\/p>\n<p>(ii) where the respondent is in loco parentis to the child, that child is a child of the applicant,<\/p>\n<p>who is not of full age, or, if the child has attained full age is suffering from a mental or physical disability to such an extent that it is not reasonably possible for him or her to live independently of the applicant;<\/p>\n<p>\u201cemergency barring order\u201d has the meaning assigned to it by section 9(3);<\/p>\n<p>\u201cfull age\u201d has the same meaning as it has in the Age of Majority Act 1985;<\/p>\n<p>\u201cinterim barring order\u201d has the meaning assigned to it by section 8(1);<\/p>\n<p>\u201cMinister\u201d means the Minister for Justice and Equality;<\/p>\n<p>\u201cprohibited degree of relationship\u201d shall be construed in accordance with subsection (2);<\/p>\n<p>\u201cprotection order\u201d has the meaning assigned to it by section 10(1);<\/p>\n<p>\u201crespondent\u201d has the meaning assigned to it by section 6, section 7 or section 9, as the case may be, and where\u2014<\/p>\n<p>(a) an interim barring order has been made the respondent to the application for the barring order to which the interim barring order relates shall be deemed to be the respondent to that interim barring order, and<\/p>\n<p>(b) a protection order has been made the respondent to the application for the safety order or the barring order to which the protection order relates shall be deemed to be the respondent to that protection order;<\/p>\n<p>\u201csafety order\u201d has the meaning assigned to it by section 6(2);<\/p>\n<p>\u201cspecified order\u201d means\u2014<\/p>\n<p>(a) a safety order, barring order, interim barring order, emergency barring order or protection order, or<\/p>\n<p>(b) an order varying or discharging an order referred to in paragraph (a);<\/p>\n<p>\u201cspouse\u201d includes a person who was a party to a marriage that has been dissolved, being a dissolution that is recognised as valid in the State;<\/p>\n<p>\u201cwelfare\u201d includes physical and psychological welfare.<\/p>\n<p>(2) For the purposes of this Act, two people are related to each other within a prohibited degree of relationship if they would be prohibited from marrying each other in the State by reason of that relationship.<\/p>\n<p>(3) For the avoidance of doubt, a relationship does not cease to be an intimate relationship for the purposes of this Act by reason only that it is no longer sexual in nature.<\/p>\n<p>Repeals<\/p>\n<p>3. The following are repealed:<\/p>\n<p>(a) section 51 of the Family Law (Divorce) Act 1996;<\/p>\n<p>(b) the Domestic Violence Act 1996;<\/p>\n<p>(c) the Domestic Violence (Amendment) Act 2002.<\/p>\n<p>Expenses<\/p>\n<p>4. The expenses incurred by the Minister and the Minister for Children and Youth Affairs in the administration of this Act shall, to such an extent as may be sanctioned by the Minister for Public Expenditure and Reform, be paid out of moneys provided by the Oireachtas.<\/p>\n<p>PART 2<\/p>\n<p>Court Proceedings<\/p>\n<h4>Factors or circumstances to which court shall have regard<\/h4>\n<p>in1 determining applications for specified orders<\/p>\n<p>5. (1) Nothing in subsection (2) shall be construed as limiting the power of a court to make a specified order under this Act.<\/p>\n<p>(2) In determining an application for a specified order, the court shall have regard to all the factors or circumstances that it considers may have a bearing on the application including where relevant:<\/p>\n<p>(a) any history of violence inflicted by the respondent on the applicant or a dependent person;<\/p>\n<p>(b) any conviction of the respondent for an offence under the Criminal Justice (Theft and Fraud Offences) Act 2001 that involves loss to, or is to the prejudice of, the applicant or a dependent person;<\/p>\n<p>(c) any conviction of the respondent for an offence that involves violence or the threat of violence to any person;<\/p>\n<p>(d) whether any violence inflicted by the respondent on the applicant or a dependent person is increasing, or has increased, in severity or frequency over time;<\/p>\n<p>(e) any exposure of any dependent person to violence inflicted by the respondent on the applicant or any other dependent person;<\/p>\n<p>(f) any previous order under this Act or the Act of 1996 made against the respondent with regard to any person;<\/p>\n<p>(g) any history of animal cruelty by the respondent;<\/p>\n<p>(h) any destruction or damage caused by the respondent to\u2014<\/p>\n<p>(i) the personal property of the applicant, the respondent or a dependent person, or<\/p>\n<p>(ii) any place where the applicant or a dependent person resides;<\/p>\n<p>(i) any action of the respondent, not being a criminal offence, which puts the applicant or a dependent person in fear for his or her own safety or welfare;<\/p>\n<p>(j) any recent separation between the applicant and the respondent;<\/p>\n<p>(k) substance abuse, including abuse of alcohol, by the respondent, the applicant or a dependent person;<\/p>\n<p>(l) access to weapons by the respondent, the applicant or a dependent person;<\/p>\n<p>(m) the applicant\u2019s perception of the risk to his or her own safety or welfare due to the behaviour of the respondent;<\/p>\n<p>(n) the age and state of health (including pregnancy) of the applicant or any dependent person;<\/p>\n<p>(o) any evidence of deterioration in the physical, psychological or emotional welfare of the applicant or a dependent person which is caused directly by fear of the behaviour of the respondent;<\/p>\n<p>(p) whether the applicant is economically dependent on the respondent;<\/p>\n<p>(q) any matter required to be considered by the court under, and in accordance with, subsections (2) and (3) of section 29;<\/p>\n<p>(r) any other matter which appears to the court to be relevant to the safety or welfare of the applicant and any dependent person.<\/p>\n<h4>Safety order<\/h4>\n<p>6. (1) (a) In this section\u2014<\/p>\n<p>\u201capplicant\u201d means a person (other than the Agency) who has applied, or a person on whose behalf the Agency has applied by virtue of section 11, for a safety order against another person (in this section referred to as \u201cthe respondent\u201d) and the person so applying or on whose behalf the Agency has so applied\u2014<\/p>\n<p>(i) is the spouse of the respondent,<\/p>\n<p>(ii) is the civil partner of the respondent,<\/p>\n<p>(iii) is not the spouse or civil partner of the respondent and is not related to the respondent within a prohibited degree of relationship, but was in an intimate relationship with the respondent prior to the application for the safety order,<\/p>\n<p>(iv) is a parent of the respondent and the respondent is of full age and is not, in relation to the parent, a dependent person,<\/p>\n<p>(v) being of full age, resides with the respondent in a relationship the basis of which is not primarily contractual, or<\/p>\n<p>(vi) is a parent of a child whose other parent is the respondent;<\/p>\n<p>\u201ckindred\u201d, in relation to two or more persons, means the relationship of each of those persons to the other person or to the rest of those persons by blood, adoption, marriage or civil partnership.<\/p>\n<p>(b) For the purposes of paragraph (a)(v), in deciding whether or not a person is residing with another person in a relationship the basis of which is not primarily contractual, the court shall have regard to\u2014<\/p>\n<p>(i) the length of time those persons are residing together,<\/p>\n<p>(ii) the nature of any duties performed by either person for the other person or any kindred person of that other person,<\/p>\n<p>(iii) the absence of any profit or of any significant profit made by either person from any monetary or other consideration given by the other person in respect of residing at the place concerned, and<\/p>\n<p>(iv) any other matters the court considers appropriate in the circumstances.<\/p>\n<p>(2) Where the court, on application to it, is of the opinion that there are reasonable grounds for believing that the safety or welfare of an applicant or a dependent person so requires, it shall, subject to section 12, by order (in this Act referred to as a \u201csafety order\u201d) prohibit the respondent to the application from doing one or more of the following:<\/p>\n<p>(a) using or threatening to use violence against, molesting or putting in fear, the applicant or the dependent person;<\/p>\n<p>(b) if he or she is residing at a place other than the place where the applicant or that dependent person resides, watching or besetting a place where the applicant or the dependent person resides;<\/p>\n<p>(c) following or communicating (including by electronic means) with the applicant or the dependent person.<\/p>\n<p>(3) A safety order may be subject to such exceptions and conditions as the court may specify.<\/p>\n<p>(4) Subject to subsection (5) and section 21, a safety order made by the District Court or by the Circuit Court on appeal from the District Court shall expire 5 years after the date of the making of the order or on the expiration of such shorter period as the court may provide for in the order.<\/p>\n<p>(5) On or before the expiration of a safety order to which subsection (4) relates, a further safety order may be made by the District Court, or by the Circuit Court on appeal from the District Court, for a period of 5 years or such shorter period as the court may provide for in the order which further order shall take effect from the date of expiration of the first-mentioned order.<\/p>\n<p>(6) On or before the expiration of a safety order, other than a safety order to which subsection (4) relates, a further safety order may be made by the District Court, or by the Circuit Court on appeal from the District Court, for a period of 5 years or such shorter period as the court may provide for in the order and that further safety order shall take effect from the date of expiration of the first-mentioned order.<\/p>\n<p>(7) The court shall not, on an application for a barring order, make a safety order unless there is also an application for a safety order before the court concerning the same matter.<\/p>\n<p>(8) Where a safety order has been made, any of the following persons may apply to have the order varied:<\/p>\n<p>(a) where the application for the order was made by the Agency in respect of a dependent person by virtue of section 11\u2014<\/p>\n<p>(i) the Agency,<\/p>\n<p>(ii) the person referred to in subsection (1)(c) of that section, or<\/p>\n<p>(iii) the respondent to that application;<\/p>\n<p>(b) where the application for the order was made by the Agency in respect of any other person (other than a dependent person referred to in paragraph (a)) by virtue of section 11 \u2014<\/p>\n<p>(i) the Agency,<\/p>\n<p>(ii) the applicant for the order, or<\/p>\n<p>(iii) the respondent to that application;<\/p>\n<p>(c) in any other case\u2014<\/p>\n<p>(i) the applicant for the order, or<\/p>\n<p>(ii) the respondent to the application for that order.<\/p>\n<p>(9) The court may, upon hearing an application under subsection (8), make such order varying the safety order as it considers appropriate in the circumstances.<\/p>\n<p>(10) For the purposes of making an application under subsection (8), a safety order made by a court on appeal from another court shall be treated as if it had been made by that other court.<\/p>\n<h4>Barring order<\/h4>\n<p>7. (1) In this section \u201capplicant\u201d means a person (other than the Agency) who has applied, or a person on whose behalf the Agency has applied by virtue of section 11, for a barring order against another person (in this section referred to as \u201cthe respondent\u201d) and the person so applying or on whose behalf the Agency has so applied\u2014<\/p>\n<p>(a) is the spouse of the respondent,<\/p>\n<p>(b) is the civil partner of the respondent,<\/p>\n<p>(c) is not the spouse or civil partner of the respondent and is not related to the respondent within a prohibited degree of relationship but lived with the respondent in an intimate relationship prior to the application for the barring order, or<\/p>\n<p>(d) is a parent of the respondent and the respondent is a person of full age who is not, in relation to the parent, a dependent person.<\/p>\n<p>(2) (a) Where the court, on application to it, is of the opinion, having taken into account any order made or to be made to which paragraph (a) or (d) of section 15(2) relates, that there are reasonable grounds for believing that the safety or welfare of the applicant or a dependent person so requires, it shall, subject to section 12, by order (in this Act referred to as a \u201cbarring order\u201d)\u2014<\/p>\n<p>(i) direct the respondent, if residing at a place where the applicant or the dependent person resides, to leave the place, and<\/p>\n<p>(ii) whether the respondent is or is not residing at a place where the applicant or the dependent person resides, prohibit the respondent from entering the place until further order of the court or until such other time as the court shall specify.<\/p>\n<p>(b) In deciding whether or not to make a barring order the court shall have regard to the safety and welfare of any dependent person in respect of whom the respondent is a parent or in loco parentis, where the dependent person is residing at the place to which the order, if made, would relate.<\/p>\n<p>(3) A barring order may, if the court thinks fit, prohibit the respondent from doing one or more of the following:<\/p>\n<p>(a) using or threatening to use violence against, molesting or putting in fear, the applicant or a dependent person;<\/p>\n<p>(b) attending at or in the vicinity of, or watching or besetting, a place where the applicant or a dependent person resides;<\/p>\n<p>(c) following or communicating (including by electronic means) with the applicant or a dependent person.<\/p>\n<p>(4) A barring order may be subject to such exceptions and conditions as the court may specify.<\/p>\n<p>(5) For the purposes of subsections (2) and (3) an applicant or a dependent person who would, but for the conduct of the respondent, be residing at a place shall be treated as residing at that place.<\/p>\n<p>(6) (a) In respect of a person who is an applicant by virtue of paragraph (c) or (d) of subsection (1), the court shall not make a barring order in respect of the place where the applicant or dependent person resides where the respondent has a legal or beneficial interest in that place and\u2014<\/p>\n<p>(i) the applicant has no legal or beneficial interest, or<\/p>\n<p>(ii) the applicant\u2019s legal or beneficial interest is, in the opinion of the court, less than that of the respondent.<\/p>\n<p>(b) Where in proceedings to which this section applies the applicant states the belief, in respect of the place to which paragraph (a) relates, that he or she has a legal or beneficial interest in that place which is not less than that of the respondent, then that belief shall be admissible in evidence.<\/p>\n<p>(7) Without prejudice to section 32, nothing in this Act shall be construed as affecting the rights of any person, other than the applicant or the respondent, who has a legal or beneficial interest in a place in respect of which the court has made an order under this section.<\/p>\n<p>(8) A barring order, if made by the District Court, or by the Circuit Court on appeal from the District Court, shall, subject to subsection (9) and section 21, expire three years after the date of its making or on the expiration of such shorter period as the court may provide for in the order.<\/p>\n<p>(9) On or before the expiration of a barring order to which subsection (8) relates, a further barring order may be made by the District Court, or by the Circuit Court on appeal from the District Court, for a period of three years or such shorter period as the court may provide for in the order and that further barring order shall take effect from the expiration of the first-mentioned order.<\/p>\n<p>(10) On or before the expiration of a barring order, other than a barring order to which subsection (8) relates, a further barring order may be made by the District Court, or by the Circuit Court on appeal from the District Court, for a period of three years or such shorter period as the court may provide for in the order and that further barring order shall take effect from the date of expiration of the first-mentioned order.<\/p>\n<p>(11) The court shall not, on an application for a safety order, make a barring order unless there is also an application for a barring order before the court concerning the same matter.<\/p>\n<p>(12) Where a barring order has been made, any of the following may apply to have the order varied:<\/p>\n<p>(a) where the application for the order was made by the Agency in respect of a dependent person by virtue of section 11 \u2014<\/p>\n<p>(i) the Agency,<\/p>\n<p>(ii) the person referred to in subsection (1)(c) of that section, or<\/p>\n<p>(iii) the respondent to that application;<\/p>\n<p>(b) where the application for the order was made by the Agency in respect of any other person (other than a dependent person referred to in paragraph (a)) by virtue of section 11 \u2014<\/p>\n<p>(i) the Agency,<\/p>\n<p>(ii) the applicant for the order, or<\/p>\n<p>(iii) the respondent to that application;<\/p>\n<p>(c) in any other case\u2014<\/p>\n<p>(i) the applicant for the order, or<\/p>\n<p>(ii) the respondent to the application for that order.<\/p>\n<p>(13) The court may, upon hearing an application under subsection (12), make such order varying the barring order as it considers appropriate in the circumstances.<\/p>\n<p>(14) For the purposes of making an application under subsection (12), a barring order made by a court on appeal from another court shall be treated as if it had been made by that other court.<\/p>\n<h4>Interim barring order<\/h4>\n<p>8. (1) Where the court, on application to it for a barring order or between the making of that application and its determination, is of the opinion, having taken into account any order made or to be made to which paragraph (a) or (d) of section 15(2) relates, that there are reasonable grounds for believing\u2014<\/p>\n<p>(a) there is an immediate risk of significant harm to the applicant or a dependent person, and<\/p>\n<p>(b) the making of a protection order would not be sufficient to protect the applicant or a dependent person,<\/p>\n<p>the court shall, subject to section 12, by order (in this Act referred to as an \u201cinterim barring order\u201d)\u2014<\/p>\n<p>(i) direct the respondent, if residing at a place where the applicant or the dependent person resides, to leave the place, and<\/p>\n<p>(ii) whether the respondent is or is not residing at a place where the applicant or the dependent person resides, prohibit that respondent from entering the place until further order of the court or until such other time as the court shall specify.<\/p>\n<p>(2) An interim barring order may, if the court thinks fit, prohibit the respondent from doing one or more of the following:<\/p>\n<p>(a) using or threatening to use violence against, molesting or putting in fear, the applicant or a dependent person;<\/p>\n<p>(b) attending at or in the vicinity of, or watching or besetting, a place where the applicant or a dependent person resides;<\/p>\n<p>(c) following or communicating (including by electronic means) with the applicant or a dependent person.<\/p>\n<p>(3) An interim barring order may be made subject to such exceptions and conditions as the court may specify.<\/p>\n<p>(4) For the purposes of subsections (1) and (2), an applicant or a dependent person who would, but for the conduct of the respondent, be residing at a place shall be treated as residing at that place.<\/p>\n<p>(5) (a) In respect of a person who is an applicant by virtue of paragraph (c) or (d) of subsection (1) of section 7, the court shall not make an interim barring order in respect of the place where the applicant or dependent person resides where the respondent has a legal or beneficial interest in that place but\u2014<\/p>\n<p>(i) the applicant has no legal or beneficial interest, or<\/p>\n<p>(ii) the applicant\u2019s legal or beneficial interest is, in the opinion of the court, less than that of the respondent.<\/p>\n<p>(b) Where in proceedings to which this section applies the applicant states the belief, in respect of the place to which paragraph (a) relates, that he or she has a legal or beneficial interest in that place which is not less than that of the respondent, then that belief shall be admissible in evidence.<\/p>\n<p>(6) Without prejudice to section 32, nothing in this Act shall be construed as affecting the rights of any person, other than the applicant or the respondent, who has a legal or beneficial interest in a place in respect of which the court has made an order under this section.<\/p>\n<p>(7) Where an interim barring order has been made, any of the following may apply to have the order varied:<\/p>\n<p>(a) where the application for the order was made by the Agency in respect of a dependent person by virtue of section 11 \u2014<\/p>\n<p>(i) the Agency,<\/p>\n<p>(ii) the person referred to in subsection (1)(c) of that section, or<\/p>\n<p>(iii) the respondent to that application;<\/p>\n<p>(b) where the application for the order was made by the Agency in respect of any other person (other than a dependent person referred to in paragraph (a)) by virtue of section 11 \u2014<\/p>\n<p>(i) the Agency,<\/p>\n<p>(ii) the applicant for the order, or<\/p>\n<p>(iii) the respondent to that application;<\/p>\n<p>(c) in any other case\u2014<\/p>\n<p>(i) the applicant for the order, or<\/p>\n<p>(ii) the respondent to the application for that order.<\/p>\n<p>(8) The court may, upon hearing an application under subsection (7), make such order varying the interim barring order as it considers appropriate in the circumstances.<\/p>\n<p>(9) For the purposes of an application under subsection (7), an interim barring order made by a court on appeal from another court shall be treated as if it had been made by that other court.<\/p>\n<p>(10) An interim barring order may be made ex parte where, having regard to the circumstances of the particular case, the court considers it necessary or expedient to do so in the interests of justice.<\/p>\n<p>(11) Where an application for an interim barring order is made ex parte, the application shall be grounded on an affidavit or information sworn by the applicant.<\/p>\n<p>(12) An affidavit or information sworn by the applicant under subsection (11) shall state whether the property from which it is sought to bar the respondent on an interim basis is also a place of business of the respondent or includes or abuts a place of business of the respondent.<\/p>\n<p>(13) If an interim barring order is made ex parte \u2014<\/p>\n<p>(a) a note of evidence given by the applicant shall be prepared forthwith\u2014<\/p>\n<p>(i) by the judge,<\/p>\n<p>(ii) by the applicant or the applicant\u2019s solicitor and approved by the judge, or<\/p>\n<p>(iii) as otherwise directed by the judge,<\/p>\n<p>and<\/p>\n<p>(b) a copy of the interim barring order, affidavit or information sworn under subsection (11) and note of evidence shall be served on the respondent as soon as practicable.<\/p>\n<p>(14) If an interim barring order is made ex parte that order shall have effect for a period, not exceeding 8 working days, specified in the order unless on application by the applicant for the barring order and on notice to the respondent the interim barring order is confirmed within that 8 day period by order of the court.<\/p>\n<p>(15) An interim barring order made ex parte shall contain a statement of the effect of subsection (14).<\/p>\n<p>(16) An interim barring order ceases to have effect on the determination by the court of the application for the barring order.<\/p>\n<h4>Emergency barring order<\/h4>\n<p>9. (1) In this section, \u201capplicant\u201d means a person (other than the Agency) who has applied, or on whose behalf the Agency has applied by virtue of section 11, for an emergency barring order against another person (in this section called \u201cthe respondent\u201d) and the person so applying or on whose behalf the Agency has so applied\u2014<\/p>\n<p>(a) is not the spouse or civil partner of the respondent and is not related to the respondent within a prohibited degree of relationship but lived with the respondent in an intimate relationship prior to the application for the emergency barring order, or<\/p>\n<p>(b) is a parent of the respondent and the respondent is a person of full age who is not, in relation to the parent, a dependent person.<\/p>\n<p>(2) The court may only make an order under this section in respect of a place where an applicant or a dependent person resides and where\u2014<\/p>\n<p>(a) the respondent has a legal or beneficial interest in the place but the applicant has no such interest, or<\/p>\n<p>(b) the applicant\u2019s legal or beneficial interest is, in the opinion of the court, less than that of the respondent.<\/p>\n<p>(3) Subject to subsection (2), where the court, on application to it, is of the opinion, having taken into account any order made or to be made to which paragraph (a) or (d) of section 15(2) relates, that there are reasonable grounds for believing that there is an immediate risk of significant harm to the applicant or a dependent person if an order is not made immediately, the court shall, subject to section 12, by order (in this Act referred to as an \u201cemergency barring order\u201d)\u2014<\/p>\n<p>(a) direct the respondent, if residing at the place where the applicant or that dependent person resides, to leave that place, and<\/p>\n<p>(b) whether the respondent is or is not residing at the place where the applicant or that dependent person resides, prohibit that respondent from entering that place for such period, not exceeding 8 working days, as is specified in the order.<\/p>\n<p>(4) An emergency barring order may, if the court thinks fit, prohibit the respondent from doing one or more of the following:<\/p>\n<p>(a) using or threatening to use violence against, molesting or putting in fear, the applicant or a dependent person;<\/p>\n<p>(b) attending at or in the vicinity of, or watching or besetting, a place where the applicant or a dependent person resides;<\/p>\n<p>(c) following or communicating (including by electronic means) with the applicant or a dependent person.<\/p>\n<p>(5) An emergency barring order may be made subject to such exceptions and conditions as the court may specify.<\/p>\n<p>(6) For the purposes of subsections (2) and (3), an applicant or a dependent person who would, but for the conduct of the respondent, be residing at a place shall be treated as residing at that place.<\/p>\n<p>(7) Without prejudice to section 32, nothing in this Act shall be construed as affecting the rights of any person, other than the applicant or the respondent, who has a legal or beneficial interest in a place in respect of which the court has made an order under this section.<\/p>\n<p>(8) Where an emergency barring order has been made, any of the following may apply to have the order varied:<\/p>\n<p>(a) where the application for the order was made by the Agency in respect of a dependent person by virtue of section 11 \u2014<\/p>\n<p>(i) the Agency,<\/p>\n<p>(ii) the person referred to in subsection (1)(c) of that section, or<\/p>\n<p>(iii) the respondent to that application;<\/p>\n<p>(b) where the application for the order was made by the Agency in respect of any other person (other than a dependent person referred to in paragraph (a)) by virtue of section 11 \u2014<\/p>\n<p>(i) the Agency,<\/p>\n<p>(ii) the applicant for the order, or<\/p>\n<p>(iii) the respondent to that application;<\/p>\n<p>(c) in any other case\u2014<\/p>\n<p>(i) the applicant for the order, or<\/p>\n<p>(ii) the respondent to the application for that order.<\/p>\n<p>(9) The court may, upon hearing an application under subsection (8), make such order varying the emergency barring order as it considers appropriate in the circumstances.<\/p>\n<p>(10) For the purposes of making an application under subsection (8), an emergency barring order made by a court on appeal from another court shall be treated as if it had been made by that other court.<\/p>\n<p>(11) An emergency barring order may be made ex parte where, having regard to the circumstances of the particular case, the court considers it necessary or expedient to do so in the interests of justice.<\/p>\n<p>(12) Where an application for an emergency barring order is made ex parte, the application shall be grounded on an affidavit or information sworn by the applicant.<\/p>\n<p>(13) An affidavit or information sworn by the applicant under subsection (12) shall state whether the property from which it is sought to bar the respondent on an emergency basis is also a place of business of the respondent or includes or abuts a place of business of the respondent.<\/p>\n<p>(14) If an emergency barring order is made ex parte \u2014<\/p>\n<p>(a) a note of evidence given by the applicant shall be prepared forthwith\u2014<\/p>\n<p>(i) by the judge,<\/p>\n<p>(ii) by the applicant or the applicant\u2019s solicitor and approved by the judge, or<\/p>\n<p>(iii) as otherwise directed by the judge,<\/p>\n<p>and<\/p>\n<p>(b) a copy of the emergency barring order, affidavit or information sworn under subsection (12) and note of evidence shall be served on the respondent as soon as practicable.<\/p>\n<p>(15) Where an emergency barring order is made ex parte it shall have effect for such period, not exceeding 8 working days, as is specified in the order.<\/p>\n<p>(16) (a) Subject to paragraph (b), where an emergency barring order has been made against a respondent, no further emergency barring order shall be made against the respondent on application by or on behalf of the same applicant unless a period of at least one month has elapsed since the expiration of the last day of the period specified in the first-mentioned order.<\/p>\n<p>(b) A further emergency barring order may be made against the respondent within the one month period referred to in paragraph (a) where the court is satisfied, having due regard to the circumstances of the respondent, that there are exceptional circumstances which justify the making of a further order.<\/p>\n<h4>Protection order<\/h4>\n<p>10. (1) Where the court, on application to it for a safety order or a barring order or between the making of that application and its determination, is of the opinion that there are reasonable grounds for believing that the safety or welfare of the applicant for the order concerned or of a dependent person so requires, the court shall by order (in this Act referred to as a \u201cprotection order\u201d) prohibit the respondent to the application from doing one or more of the following:<\/p>\n<p>(a) using or threatening to use violence against, molesting or putting in fear, the applicant or the dependent person;<\/p>\n<p>(b) if he or she is residing at a place other than the place where the applicant or the dependent person resides, watching or besetting the place where the applicant or the dependent person resides;<\/p>\n<p>(c) following or communicating (including by electronic means) with the applicant or that dependent person.<\/p>\n<p>(2) A protection order may be subject to such exceptions and conditions as the court may specify.<\/p>\n<p>(3) For the purposes of this section, an applicant or a dependent person who would, but for the conduct of the respondent, be residing at a place shall be treated as residing at that place.<\/p>\n<p>(4) Where a protection order has been made, any of the following may apply to have the order varied:<\/p>\n<p>(a) where the application for the order was made by the Agency in respect of a dependent person by virtue of section 11\u2014<\/p>\n<p>(i) the Agency,<\/p>\n<p>(ii) the person referred to in subsection (1)(c) of that section, or<\/p>\n<p>(iii) the respondent to that application;<\/p>\n<p>(b) where the application for the order was made by the Agency in respect of any other person (other than a dependent person referred to in paragraph (a)) by virtue of section 11 \u2014<\/p>\n<p>(i) the Agency,<\/p>\n<p>(ii) the applicant for that order, or<\/p>\n<p>(iii) the respondent to that application;<\/p>\n<p>(c) in any other case\u2014<\/p>\n<p>(i) the applicant for the order, or<\/p>\n<p>(ii) the respondent to the application for that order.<\/p>\n<p>(5) The court may, upon hearing an application under subsection (4), make such order varying the protection order as it considers appropriate in the circumstances.<\/p>\n<p>(6) For the purposes of making an application under subsection (4), a protection order made by a court on appeal from another court shall be treated as if it had been made by that other court.<\/p>\n<p>(7) A protection order may be made ex parte where, having regard to the circumstances of the particular case, the court considers it necessary or expedient to do so in the interests of justice.<\/p>\n<p>(8) Where an application for a protection order is made ex parte, the application shall be grounded on an affidavit or information sworn by the applicant.<\/p>\n<p>(9) If a protection order is made ex parte \u2014<\/p>\n<p>(a) a note of evidence given by the applicant shall be prepared forthwith\u2014<\/p>\n<p>(i) by the judge,<\/p>\n<p>(ii) by the applicant or the applicant\u2019s solicitor and approved by the judge, or<\/p>\n<p>(iii) as otherwise directed by the judge,<\/p>\n<p>and<\/p>\n<p>(b) a copy of the protection order, affidavit or information sworn under subsection (8) and note of evidence shall be served on the respondent as soon as practicable.<\/p>\n<p>(10) A protection order shall cease to have effect on the determination by the court of the application for a safety order or a barring order.<\/p>\n<p>S.I. (1) These Rules, which shall come into operation on the 15th day of March 2019, may be cited as the District Court (Domestic Violence) Rules 2019.<\/p>\n<p>(2) These Rules shall be construed together with the District Court Rules 1997 ( S.I. No. 93 of 1997 ) and all other District Court Rules.<\/p>\n<p>(3) The District Court Rules as amended by these Rules may be cited as the District Court Rules 1997 to 2019.<\/p>\n<p>2. The District Court Rules 1997 ( S.I. No. 93 of 1997 ) are amended:<\/p>\n<p>(i) by the substitution for Order 59 thereof of the Order set out in Schedule 1, and<\/p>\n<p>(ii) by the substitution for rule 4 of Order 61A of the following rule:<\/p>\n<p>\u201cAccompanying persons and support workers<\/p>\n<p>4. (1) Where a party (in this rule referred to as the \u201capplicant\u201d) wishes to be accompanied in court in any proceedings referred to in section 40(5) of the 2004 Act, save for proceedings to which section 26 of the Domestic Violence Act 2018 applies, by another person (in this rule referred to as \u201cthe accompanying person\u201d), the applicant must, unless the Court otherwise directs, complete a notice of application in the Form 61A.1, Schedule C.<\/p>\n<p>(2) Where the other party or parties agree to the accompanying person, the applicant must lodge Form No. 61A.1 duly completed, with the Clerk prior to the commencement of the hearing in the proceedings, and must apply to the Court at that hearing to approve the accompanying person and for such directions as the Court may give under section 40(5) of the 2004 Act.<\/p>\n<p>(3) Except in ex parte applications, where the other party or parties have not agreed to the accompanying person, the applicant must, by application to the Court in the Form No. 61A.1, on notice to the other party or parties, returnable not later than seven days prior to the date fixed for the hearing in such proceedings, apply to the Court to approve the accompanying person and for such directions as the Court may give under section 40(5) of the 2004 Act.<\/p>\n<p>(4) In ex parte applications, subject to the lodgment of Form No. 61A.1 duly completed in accordance with sub-rule (1), the approval of any accompanying person is at the discretion of the Court.<\/p>\n<p>(5) On any application concerning an accompanying person, the Court, having heard any submission made by or behalf of any other party to the proceedings, may allow the accompanying person to attend the proceedings (or any part of the proceedings) subject to such directions as the Court may give in that regard.<\/p>\n<p>(6) The Court may, of its own motion or on the application of any party or person, vary or modify any directions given under section 40(5) of the 2004 Act during the course of the proceedings.<\/p>\n<p>(7) Where an applicant in proceedings under the Domestic Violence Act 2018 wishes to be accompanied in court in the proceedings by an individual (including a support worker) in accordance with section 26 of the Domestic Violence Act 2018 , the applicant must, before or at the commencement of the hearing in the proceedings, provide the Court with details of the name and address of the individual accompanying the applicant and, where the individual is a support worker, the name and address of the organisation with which the support worker volunteers, or by which the support worker is employed or engaged.<\/p>\n<p>(8) The Court may, of its own motion or on the application of any party or person, make an order under section 26(2) of the Domestic Violence Act 2018 at any stage of the proceedings.\u201d<\/p>\n<p>3. (1) The Forms 59.1 to 59.16 inclusive and 61A.1 in Schedule 2 shall be substituted for the forms bearing the like numbers respectively set out in Schedule C to the District Court Rules.<\/p>\n<p>(2) The Forms 59.17, 59.18 and 59.19 in Schedule 2 shall be added to the forms in Schedule C to the District Court Rules immediately following Form 59.16.<\/p>\n<p>Schedule 1<\/p>\n<p>\u201cOrder 59<\/p>\n<p>Domestic Violence<\/p>\n<p>Definitions<\/p>\n<p>1. In this Order-<\/p>\n<p>the \u201c2018 Act\u201d means the Domestic Violence Act 2018 (No. 6 of 2018);<\/p>\n<p>\u201cAgency\u201d means the Child and Family Agency, and unless the context otherwise requires, words and phrases used in this Order which are defined in section 2 of the 2018 Act have the same meaning as in the 2018 Act.<\/p>\n<p>Venue<\/p>\n<p>2. Proceedings under this Order may be brought, heard and determined before:<\/p>\n<p>(i) a sitting of the District Court for the Court District in which the applicant resides or is treated by the Court in accordance with section 22(2) of the 2018 Act as residing or, if the application is for a barring order or an emergency barring order, where there is situate the place in relation to which that application is made, or<\/p>\n<p>(ii) a special sitting of the District Court arranged in accordance with section 24(3) of the 2018 Act.<\/p>\n<p>Hearing otherwise than in public<\/p>\n<p>3. Proceedings under the 2018 Act must, subject to section 23 of the 2018 Act, be heard otherwise than in public and only officers of the Court, the parties and their legal representatives, witnesses (subject to the provisions of Order 8, rule 2) and such other persons as the Judge in the exercise of his or her discretion allows, may be permitted to be present at the hearing.<\/p>\n<p>Safety Order<\/p>\n<p>4. (1) An application to the Court under section 6 of the 2018 Act for a safety order must be preceded by the issue and service upon the respondent of a summons in the Form 59.1, Schedule C.<\/p>\n<p>(2) An order of the Court granting the application may be in the Form 59.2, Schedule C.<\/p>\n<p>Barring Order<\/p>\n<p>5. (1) An application to the Court under section 7 of the 2018 Act for a barring order must be preceded by the issue and service upon the respondent of a summons in the Form 59.3, Schedule C.<\/p>\n<p>(2) An order of the Court granting the application may be in the Form 59.4, Schedule C.<\/p>\n<p>Interim barring order<\/p>\n<p>6. (1) When a summons for a barring order has been issued, an application to the Court under section 8(1) of the 2018 Act for an interim barring order (save where made in the course of the hearing of an application for a barring order):<\/p>\n<p>(i) may be made by motion on notice in the Form 59.5, Schedule C, to the respondent (such notice and a copy of the grounding affidavit or information to be served on the respondent at least two clear days before the hearing) and grounded on an affidavit sworn by the applicant, or on information on oath and in writing sworn by the applicant in the Form 59.6, Schedule C; or<\/p>\n<p>(ii) where, having regard to the circumstances of the particular case, the Court considers it necessary or expedient in the interests of justice, may be made ex parte grounded on an affidavit sworn by the applicant, or on information on oath and in writing sworn by the Applicant in the Form 59.6, Schedule C.<\/p>\n<p>(2) An interim barring order may be made ex parte notwithstanding the fact that the summons required by rule 5 has not been served.<\/p>\n<p>(3) An order of the Court granting the application may be in the Form 59.7, Schedule C.<\/p>\n<p>(4) In any case under this rule, the Court may hear evidence viva voce and on oath.<\/p>\n<p>Emergency Barring Order<\/p>\n<p>7. (1) An application to the Court under section 9(3) of the 2018 Act for an emergency barring order must, subject to sub-rule (3), be preceded by the issue and service upon the respondent of a summons in the Form 59.17, Schedule C.<\/p>\n<p>(2) An application to the Court under section 9 of the 2018 Act for an emergency barring order:<\/p>\n<p>(i) may be made on the date on which the summons has been listed for hearing (provided the summons has been served on the respondent at least two clear days before the hearing) and grounded on an affidavit sworn by the applicant, or on information on oath and in writing sworn by the applicant in the Form 59.18, Schedule C; or<\/p>\n<p>(ii) may, where the Court considers it necessary or expedient in the interests of justice having regard to the circumstances of the particular case, be made ex parte grounded on an affidavit sworn by the applicant, or on information on oath and in writing sworn by the Applicant in the Form 59.18, Schedule C.<\/p>\n<p>(3) An emergency barring order may be made ex parte notwithstanding the fact that the summons required by sub-rule (1) has not been served.<\/p>\n<p>(4) An order of the Court granting the application may be in the Form 59.19, Schedule C.<\/p>\n<p>(5) In any case under this rule, the Court may hear evidence viva voce and on oath.<\/p>\n<p>Protection Order<\/p>\n<p>8. (1) An application to the Court of the 2018 Act for a protection order under section 10(1) (save where made in the course of the hearing of an application for a safety order or a barring order):<\/p>\n<p>(i) may be made by motion on notice to the respondent (such notice to be served on the respondent at least two clear days before the hearing) and in such case may be grounded on the evidence of the applicant viva voce and on oath; or<\/p>\n<p>(ii) where, having regard to the circumstances of the particular case, the Court considers it necessary or expedient in the interests of justice, may be made ex parte grounded on an affidavit sworn by the applicant, or on information on oath and in writing sworn by the applicant in the Form 59.8, Schedule C.<\/p>\n<p>(2) An order of the Court granting a protection order may be in the Form 59.9, Schedule C.<\/p>\n<p>Vary Safety\/ Barring\/ Interim Barring\/ Emergency Barring Order\/ Protection Order<\/p>\n<p>9. (1) An application to the Court under section 6(8) to vary a safety order, section 7(12) to vary a barring order, section 8(7) to vary an interim barring order, section 9(8) to vary an emergency barring order or section 10(4) to vary a protection order, must be preceded by the issue and service of a summons in the Form 59.10, Schedule C.<\/p>\n<p>(2) An order of the Court granting the application may be in the Form 59.11, Schedule C.<\/p>\n<p>Discharge Safety\/Barring\/ Interim Barring \/ Emergency Barring\/ Protection Order<\/p>\n<p>10. (1) An application to the Court under section 21 of the 2018 Act for the discharge of a safety order, a barring order, an interim barring order, an emergency barring order or a protection order must be preceded by the issue and service of a summons in the Form 59.12, Schedule C.<\/p>\n<p>(2) An order of the Court granting the application may be in the Form 59.13, Schedule C.<\/p>\n<p>Clerk to supply copies of orders<\/p>\n<p>11. (1) Where the Court makes, varies or discharges a safety order or a protection order, the Clerk must, in accordance with section 19(1) of the 2018 Act, give or send a certified copy of the order in question as soon as practicable:<\/p>\n<p>(a) to the applicant for the safety order or, in respect of a protection order, the applicant for the safety order or barring order concerned,<\/p>\n<p>(b) to the respondent to the application for the safety order or in respect of a protection order, the respondent to the application for the safety order or barring order concerned,<\/p>\n<p>(c) where the Agency by virtue of section 11 of the 2018 Act made the application for the safety order or, in respect of a protection order, for the safety order or barring order, to the Agency,<\/p>\n<p>by ordinary prepaid post, and<\/p>\n<p>(d) to the member of the Garda S[html]och[html]na in charge of the Garda S[html]och[html]na station for the area in which the person for whose benefit the safety order or protection order was made resides, and<\/p>\n<p>(e) where the order in question is a variation or discharge of a safety order or a protection order and the person for whose benefit the order was made had previously resided elsewhere, to the member of the Garda S[html]och[html]na in charge of the Garda S[html]och[html]na station for the area in which that person had so resided but only if that member had previously been sent under this rule a copy of such safety order or protection order or any order relating thereto,<\/p>\n<p>by prepaid registered post or, where so agreed with the member of the Garda S[html]och[html]na concerned, by electronic mail.<\/p>\n<p>(2) Where the Court makes, varies or discharges a barring order or an interim barring order, the Clerk must, in accordance with section 19(2) of the 2018 Act, give or send a certified copy of the order in question as soon as practicable:<\/p>\n<p>(a) to the applicant for the barring order,<\/p>\n<p>(b) to the respondent to the application for the barring order,<\/p>\n<p>(c) where the Agency by virtue of section 11 of the 2018 Act made the application for the barring order concerned, to the Agency,<\/p>\n<p>by ordinary prepaid post, and<\/p>\n<p>(d) to the member of the Garda S[html]och[html]na in charge of the Garda S[html]och[html]na station for the area in which is situate the place in relation to which the application for the barring order was made, and<\/p>\n<p>(e) where the order in question is a variation or discharge of a barring order or an interim barring order and the place in respect of which the previous order was made is elsewhere, to the member of the Garda S[html]och[html]na in charge of the Garda S[html]och[html]na station for the area in which is situated that place but only if that member had previously been sent under this rule a copy of such barring order or interim barring order or any order relating thereto,<\/p>\n<p>by prepaid registered post or, where so agreed with the member of the Garda S[html]och[html]na concerned, by electronic mail.<\/p>\n<p>(3) Where the Court makes, varies or discharges an emergency barring order, the Clerk must in accordance with section 19(3) of the 2018 Act, give or send a certified copy of the order as soon as practicable:<\/p>\n<p>(a) to the applicant for the emergency barring order,<\/p>\n<p>(b) to the respondent to the application for the emergency barring order,<\/p>\n<p>(c) where the Agency by virtue of section 11 of the 2018 Act made the application for the emergency barring order concerned, to the Agency,<\/p>\n<p>by ordinary prepaid post, and<\/p>\n<p>(d) to the member of the Garda S[html]och[html]na in charge of the Garda S[html]och[html]na station for the area in which is situate the place in relation to which the application for the emergency barring order was made, and<\/p>\n<p>(e) where the order in question is a variation or discharge of an emergency barring order and the place in respect of which the previous order was made is elsewhere, to the member of the Garda S[html]och[html]na in charge of the Garda S[html]och[html]na station for the area in which is situated that place but only if that member had previously been sent under this Rule a copy of such emergency barring order or any order relating thereto,<\/p>\n<p>by prepaid registered post or, where so agreed with the member of the Garda S[html]och[html]na concerned, by electronic mail.<\/p>\n<p>Clerk to notify Garda[html] when Protection Order\/Interim Barring Order\/Emergency Barring Order ceases to have effect<\/p>\n<p>12. (1) Where a protection order has been made and:<\/p>\n<p>(i) the application for a safety order or a barring order has been determined, or<\/p>\n<p>(ii) the protection order is discharged before the application for a safety order or a barring order has been determined<\/p>\n<p>the Clerk must send notice in the Form 59.14, Schedule C that the protection order has ceased to have effect, by prepaid registered post or, where so agreed with the member of the Garda S[html]och[html]na concerned, by electronic mail, to the member of the Garda S[html]och[html]na referred to in rule 11(1)(d) or (e), as the case may be.<\/p>\n<p>(2) Where an interim barring order has been made and the interim barring order has ceased to have effect otherwise than by expiry of the time for which the order is stated on its face to be in force, the Clerk must send notice in the Form 59.14, Schedule C that the interim barring order has ceased to have effect, by prepaid registered post or, where so agreed with the member of the Garda S[html]och[html]na concerned, by electronic mail, to the member of the Garda S[html]och[html]na referred to in Rule 11(2)(d) or (e), as the case may be.<\/p>\n<p>(3) Where an emergency barring order has been made and the emergency barring order has ceased to have effect otherwise than by expiry of the time for which the order is stated on its face to be in force, the Clerk must send notice in the Form 59.14, Schedule C that the emergency barring order has ceased to have effect, by prepaid registered post or, where so agreed with the member of the Garda S[html]och[html]na concerned, by electronic mail, to the member of the Garda S[html]och[html]na referred to in rule 11(3)(d) or (e), as the case may be.<\/p>\n<p>Service<\/p>\n<p>13. (1) A summons issued under this Order must be served by the Clerk by prepaid ordinary post upon the person to whom it is directed at least seven days before the date fixed for the hearing of the application. Where, however, the Clerk, having consulted the Judge for the time being assigned to the Court District in which the summons is being issued, otherwise certifies on the summons that the proceedings are urgent, the summons may be served at least two days before the date fixed for the hearing.<\/p>\n<p>(2) The Clerk must endorse on the original of every such summons served the date and place of posting of the envelope containing the copy summons for service and the party to whom the envelope was posted (or such other particulars of service as are appropriate to the case) and that endorsement shall be prima facie evidence of such service.<\/p>\n<p>(3) The summons shall be deemed to be issued when it has been signed by the Judge or the Clerk. It shall be deemed to be served at the time at which the said envelope would be delivered in the ordinary course of post.<\/p>\n<p>(4) Without prejudice to the power of the Court to give such a direction of its own motion, a request for a direction under section 18(4) of the 2018 Act may be made viva voce at the time the order is made or if made subsequently may be made ex parte at any sitting of the Court for the Court District.<\/p>\n<p>(5) The Court may, for the purpose of ensuring the expeditious hearing of applications under the 2018 Act in accordance with section 31 of the 2018 Act, direct or deem sufficient service of a document under the 2018 Act by other means, including by electronic mail, where it is satisfied that such service is likely to bring, or has brought, the document to the attention of the person to be served.<\/p>\n<p>Effect of appeal from orders<\/p>\n<p>14.
