Prior to 1987 legislation, the non-marital children of a deceased did not qualify for a share of his estate on intestacy.\u00a0 A challenge to the Constitutionality of the pre-1987 position was rejected by the Supreme Court.<\/p>\n
The Court could not find the differences were necessarily unreasonable, unjust or arbitrary. The Court in part justified the discrimination on the basis of the Constitutional recognition of the primacy of the family based on marriage.<\/p>\n
In OB v. S, the Supreme Court held that the discrimination against non-matrimonial children in relation to inheritance rights was permissible due to the protection afforded by the family by Article 41. The provision, although clearly discrimiChildrenatory was aimed at maintaining the primacy of the family as the fundamental unit group of society.<\/p>\n\n
