Public Sector Licences

Most of the Legal Materials parts of the Chapters on this Site is reproduced pursuant to Directive 2003/98/EC as amended by Directive 2013/37/EU of the European Parliament and of the Council on the reuse of public sector information/ They are transposed into law in Ireland (S.I. 279/2005 and S.I. 525/2015) and in the United Kingdom (Regulation 2015 No. 1415).Commission Decision (2011/833/EU) applies to the reuse of EU Commission documents. 

Irish public sector information is reproduced pursuant to PSI Licence; Conditions of Re-Use of Public Sector Information. The Legal Materials contain Irish Public Sector Information licensed under the Irish Licence which is at http://circulars.gov.ie/pdf/circular/per/2016/12.pdf (the Irish Licence).

UK public sector information is reproduced pursuant to the Open Government Licence  The Legal Materials contain UK public sector information licensed under the Open Government Licence v3.0. The Licence is available at http://www.nationalarchives.gov.uk/doc/open-government-licence/version/3/ (the UK Licence).

The Legal Materials contain European Union public sector information. EU public information is reproduced pursuant to Commission Decision of 12 December 2011 on the reuse of Commission documents (2011/833/EU) (the EU Decision)

No Right to Re-Use

The copyright in the text of legislation, judgments and other legal material displayed on the website may belong to courts, other government bodies, judges, and/or to other entities. Copyright in the markup and all other presentational / value-added aspects of judgments may belong to third parties. Irish Legal Guide does not and cannot authorise any copying or use of such material, beyond that allowed by law and the copyright policy of the relevant copyright owners.

The presence on the site of public sector legal material does not warrant grant or imply the existence of any right to use it beyond that allowed by the original information provider and by law. Irish Legal Guide cannot authorise the copying or re-use of such material. 

Judgments

Irish Court Judgments are copyright of the Irish Courts and Courts Service. The Judgments provided may be extracts only and may not be the whole judgment. They judgments provided may not be the authorised version. The authorised version of a judgment is that signed or approved by the judge or court concerned and retained in the court records. The judgments are liable to editorial revision or correction.

UK Judgments are understood to be subject to Crown copyright protection and licensed for use under the UK Licence. The Judgments provided may be extracts only and may not be the whole judgment. They judgments provided may not be the authorised version. The authorised version of a judgment is that signed or approved by the judge or court concerned and retained in the court records. The judgments are liable to editorial revision or correction.No responsibility is accepted by or on behalf of the Secretary of State for any errors, omissions, or misleading statements on these pages or any site to which these pages connect, including any feature or aspect of such site or pages, whether provided by us, other Departments or Agencies of Her Majesty’s Government or by any organisation, company or individual.

The texts and information contained in the EU Court of Justice’s website are public information.The texts of the judgments, orders, Opinions, notices and other documents present on the site are subject to amendment. The final version of those texts is published in the Reports of Cases before the Court of Justice and the General Court, the European Court Reports – Staff Cases (ECR-SC) or the Official Journal of the European Union , which are the only authentic versions and take precedence in the event that there is a difference with the electronic version.

 

Irish PSI Licence 

The Irish Licence does not grant users any right to use: 

  • personal Information, unless sufficiently anonymised and/or aggregated;
  • third party rights and other intellectual property rights that the information provider is not authorised to license including, but not limited to, patents, copyright, database rights or trademarks; 
  • the names, crests, logos, or other official symbols of the information provider. 

All data linked to the Open Data portal is published “as is”. The Information is licensed ‘as is’ and the information provider and/or Licensor excludes all representations, warranties, obligations and liabilities in relation to the Information to the maximum extent permitted by law. ?The information provider and/or Licensor are not liable for any errors or omissions in the Information and shall not be liable for any loss, injury or damage of any kind caused by its use. The Information Provider does not guarantee the continued supply of the Information. ?The Licence is made under the laws of Ireland and come under the exclusive jurisdiction of the courts of Ireland.

UK Open Government Licence

The UK Licence does not grant users any right to use:

  • personal data in the information;
  • information that has not been accessed by way of publication or disclosure under information access legislation (including the Freedom of Information Acts for the UK and Scotland) by or with the consent of the Information Provider;
  • departmental or public sector organisation logos, crests and the Royal Arms except where they form an integral part of a document or dataset;
  • military insignia;
  • third party rights the information provider is not authorised to license;
  • other intellectual property rights, including patents, trademarks, and design rights; and
  • identity documents such as the British Passport

The licence does not grant any right to use the Information in a way that suggests any official status or that the information provider and/or Licensor endorse you or your use of the Information. The Information is licensed ‘as is’ and the Information Provider and/or Licensor excludes all representations, warranties, obligations and liabilities in relation to the Information to the maximum extent permitted by law. The information provider and/or Licensor are not liable for any errors or omissions in the Information and shall not be liable for any loss, injury or damage of any kind caused by its use. The Information Provider does not guarantee the continued supply of the Information.

EU Decision

The EU Decision does not apply

  • to software or to documents covered by industrial property rights such as patents, trademarks, registered designs, logos and names;
  • to documents for which the Commission is not in a position to allow their reuse in view of intellectual property rights of third parties;
  • to documents which pursuant to the rules established in Regulation (EC) No 1049/2001 are excluded from access or only made accessible to a party under specific rules governing privileged access;
  • to confidential data, as defined in Regulation (EC) No 223/2009 of the European Parliament and of the Council (6); 
  • to documents resulting from ongoing research projects conducted by the staff of the Commission which are not published or available in a published database, and whose reuse would interfere with the validation of provisional research results or where reuse would constitute a reason to refuse registration of industrial property rights in the Commission’s favour.
